Defending WC Claims

Atlanta Workers' Compensation Defense Attorney

Georgia employers and their workers' compensation insurers have a valuable asset in Skedsvold & White, LLC, a law firm committed to defending business interests in connection with workplace injury claims.

Taking a Firm Stance in the Face of an Unwarranted Workers' Compensation Claim

We make it a point to accept as clients those employers and insurers that genuinely agree with our policy of ethical legal advocacy. On the other hand, when an excessive or unsubstantiated workers' compensation claim presents itself, an employer and/or the employer's insurer often has to take a firm stance to prevent exploitation through the workers' compensation process. A business owner, manager or officer has a duty to protect assets by preventing abuse of the system designed to serve as a safety net for employees with qualifying injuries or illnesses.

Representing Employers and Insurers

Skedsvold & White, LLC, has represented employers and insurers throughout the state before the Georgia State Board of Workers' Compensation. Throughout our history, Skedsvold & White, LLC, has maintained an active and diverse workers' compensation practice. We handle all aspects of workers' compensation claims, including initial "all issues" claims for benefits, change in condition claims, death claims and catastrophic claims.

Our Clients Include Insurers, Self-Insured Employers and Non-Insured Companies

Our clients consist not only of many nationally known insurance carriers but also self-insured employers and non-insured companies. As part of our workers' compensation practice, our attorneys have advised our clients regarding the impact of the Americans with Disabilities Act and Family and Medical Leave Act (ADA and FMLA) on workers' compensation claims. We also have vast experience dealing with industrial and occupation disease claims and repetitive use injuries.

  4. Wanda, thanks for reading and posting a comment. I do hope that SOMEONE is reading so it's nice to see a comment. I do have a couple of suggestions for you. They are of a general nature since I would have to defer to your expertise on Minnesota law. First, our clients need to know the whole and unvarnished truth of their situation, how they got there and how to avoid it in the future. Part of the art of practicing law is telling the client that they messed up without using the words, "you messed up." Most of the time they know that anyway. As a defense attorney, I feel an obligation to tell the client not only the strengths/weaknesses of the claim defense but also the cost to vindicate the position. If we can defend a case and win it for $10,000 but can settle it now for $5000, I firmly believe that I have an ethical obligation the client to let them decide whether the "principle" needs to be vindicated in this forum. Otherwise, I am watching out for my interests and not their interests. Second, your reputation is everything to you. Your clients come to you for advice and representation and you can do no good for them if your reputation is anything other than one of complete candor and professionalism. Clients need to understand that any lawyer that will lie for you, will lie to you. Your reputation is on display in everything that you do and too often our brothers in the bar will lie when the truth will do. Lastly, there is a time and a place for aggressive litigation tactics but that cannot be the only tool in your litigation toolbox. Make it so and you are easily predictable and beatable. Don't underestimate the value of good collegial relationships with opposing counsels and don't let your clients resent your good rapport with your adversaries. Sooner or later, we all will need a favor or an accommodation so be very accommodating even, and perhaps especially, to those attorneys who least deserve it. You can do this while at the same time protecting your client and yourself. All the best.

  5. It's a shame I don't live in Atlanta. I would come in for face to face advice! I live in Las Vegas and I need a workers compensation attorney. I busted my hip on the job and I honestly don't have the means of paying for the hospital and other bills. Any advice Kevin?

  6. Yes i have some more things who helps you lot in this journey, it will not be possible for you to prove your claims against the medical boards. Remember, you need to gather as many proofs as you can for the representation of the case. You also need to consult and coordinate with your lawyer properly for securing a win in the case.
